Acceptance of Terms and Conditions

By enrolling in a Course offered by The Digital Workshop, you agree to be bound by these Terms and Conditions.

Registration

Payment in full for the Course is due and payable upon enrollment. You will receive a confirmation of enrollment via email.

Cancellations, Transfers and Substitutions.

If you are enrolled in a Course and fail to attend, you will not receive a refund, either in part or in full. If you know you will not be able to attend a scheduled Course, you have the following options:

Cancellations

If you cancel your enrollment in the Course by providing The Digital Workshop notice no less than 3 business days prior to the scheduled Course start date and time, you will receive a full refund. Cancellations with less than 3 business days prior notice will not receive a refund. For purposes of this Section 2(a), notice must be given by either (i) calling 717.400.1700 and speaking to a Course Coordinator, or (ii) email to info@thedigitalworkshop.com which will be confirmed by a return email from the Course Coordinator.

Transfers

You may transfer to another scheduled Course (of the same or lesser value) that is scheduled to be given within sixty days of the originally scheduled Course. Transfers must be made by calling The Digital Workshop at 717.400.1700.

Substitution

You may send a substitute attendee to the Course in your place. No advance notice of substitutions is required

WARRANTY; LIMITATIONS

THE DIGITAL WORKSHOP WARRANTS TO YOU THAT THE COURSE IN WHICH YOU ENROLL WILL BE LEAD BY A PERSON TRAINED IN THE USE OF THE SOFTWARE, PROGRAMMING LANGUAGE, WEB SITE OR TECHNIQUE WHICH IS THE SUBJECT MATTER OF THE COURSE. THIS IS THE DIGITAL WORKSHOP'S EXCLUSIVE WARRANTY WITH REGARD TO THE COURSE, AND THE DIGITAL WORKSHOP DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED. THE DIGITAL WORKSHOP SHALL NOT BE LIABLE FOR ANY CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR EXEMPLARY DAMAGES (EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES) RELATING TO ANY COURSE OR THESE TERMS AND CONDITIONS, REGARDLESS OF THE THEORY OF LIABILITY ON WHICH SUCH DAMAGES MAY BE BASED. THE DIGITAL WORKSHOP SHALL NOT BE LIABLE FOR YOUR USE OF THE INFORMATION OR KNOWLEDGE YOU ACQUIRE DURING THE COURSE, INCLUDING ANY CONSEQUENCES THAT FLOW THEREFROM.

Satisfaction Gurantee

The Digital Workshop is committed to providing quality software training. If you are dissatisfied with the Course in any way, you may retake the Course once at no additional cost within three months of your original Course if scheduled within a month of the initial class.

Inclement Weather Policy

The Digital Workshop recognizes that many people have difficulties traveling to work when it snows or other inclement weather occurs. The Digital Workshop will follow Manheim Townships' school closures, (not delays). If The Digital Workshop cancels a Course due to inclement weather, The Digital Workshop will make every effort to reschedule you in an upcoming Course (of the same value) that works with your schedule or will refund your payment in full.

Miscellaneous

Cancellations by The Digital Workshop. The Digital Workshop reserves the right to cancel Courses for low enrollment or for reasons beyond its control. If The Digital Workshop cancels your Course for a reason other than inclement weather, you will have the option of receiving a full refund or enrolling in a later administration of the Course.

Respecting that students have made an investment of time and treasure in learning, The Digital Workshop is not equipped to accommodate children under the age of 13. The Digital Workshop will do its best to reschedule you for another time should your childcare fall through, though no guarantees can be made, nor will you be eligible for a refund without the proper cancellation notice.

Course as a Service

Notwithstanding the possible provision of textbooks and other learning aids in connection with a Course, the parties agree that a Course is a service, not goods within the meaning of the Uniform Commercial Code.

Headings

The section and subsection headings used in these Terms and Conditions are set forth solely for the convenience of the parties and shall not be used in construing or interpreting these Terms and Conditions.

Governing Law

These Terms and Conditions are governed by, and shall be construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to principles of conflicts of laws.

Changes to these Terms and Conditions

The Digital Workshop reserves the right to change these Terms and Conditions at any time by posting a new version thereof on this Website. Please check this page periodically for changes.
